Abstract
The sale of goods act is a key piece of legislation in Indian commercial law that governs
the contracts relating to the sale and purchase of goods. Before the enactment the law
governing such transactions was embedded within the Indian contract act 1872.
Understanding the needs of a distinct detailed framework for the trade of goods, the sale
of goods was passed as a separate statute. The sale of goods act 1930 governs contracts
for the sale of goods in India. It defines a contract of sale as a transaction where the seller
transfers or agrees to transfer ownership of goods to a buyer for a price. The act outlines
the essential elements of such a contract, including the transfer of ownership, the nature
of goods and the role of price etc. it also addressed the distinction between a sale and an
agreement to sell, as well as the rights and obligations of buyers and sellers including
remedies for breach of contract.
